Do I have to try mediation before going to the tribunal?

Yes in most states. NSW and QLD require you to attempt mediation through Fair Trading or the Commissioner before lodging an application. The mediation is free and resolves a high percentage of disputes without a hearing.

Even where mediation isn't compulsory, the tribunal often expects you to have made reasonable attempts to resolve the issue first. Genuine effort to mediate strengthens your case if you do end up at a hearing — and saves a lot of time and stress if it works.
